MOTAT Online Tickets Terms and Conditions

MOTAT ONLINE TICKETS TERMS AND CONDITIONS

1          General

1.1      Please read these Terms and Conditions carefully before purchasing a Ticket.  By purchasing a Ticket from MOTAT you agree to be bound by these Terms and Conditions.

1.2      All prices quoted on MOTAT’s website are in New Zealand dollars and are inclusive of Goods and Services Tax.

1.3      Purchase of MOTAT Tickets is subject these Terms and Conditions.

2          Definitions

2.1      In these Terms and Conditions, and unless the context requires otherwise:

(a)       General Admission Ticket and General Admission Family Ticket means a Ticket purchased for general entry to MOTAT and not to any Event or Programme requiring a Special Ticket;

(b)       MOTAT means the Museum of Transport and Technology;

(c)       MOTAT Mates Ticket means a Ticket purchased for unlimited general entry to MOTAT (and to no other Event or Programme requiring a Special Ticket), for a period of one year from the date of purchase, and includes the following Tickets:

(i)        MOTAT Mates Annual Pass, which is valid for one person;

(ii)       MOTAT Mates Family Pass, which is valid for two adults and up to four children aged 5-16 years old; and

(iii)      MOTAT Mates Child Flexi Pass, which is valid for one child under 17 years of age and any accompanying parent, guardian or supervising adult.

(d)       Event means any event hosted or promoted by MOTAT or advertised by MOTAT on its website or otherwise;

(e)       Special Ticket means a Ticket purchased specifically for entry to:

(i)        any specific Event;

(ii)        any specific Programme.

(f)        Terms and Conditions means these Terms and Conditions and any other terms and conditions referred to within these Terms and Conditions;

(g)       Ticket means any tickets purchased for entry to MOTAT;

(h)       Visitor means person holding a Ticket purchased subject to these Terms and Conditions; and

(i)        Programme means any workshop or programme of a cultural, entertainment or educational nature (including school holiday programmes) held at MOTAT.

3          Tickets - Conditions

3.1      Visitors will not be admitted to MOTAT without a valid Ticket, issued in accordance with, and subject to clauses 4, 5 or 6.

3.2      Visitors must retain their Ticket at all times while at MOTAT and produce their Ticket for inspection at any time if required by MOTAT staff.

3.3      Tickets may be invalidated if any part is removed, altered or defaced and MOTAT reserves the right to charge a reasonable fee for the replacement of damaged Tickets.

3.4      Tickets may not be cancelled, exchanged or refunded except as provided for in clause 10. 

3.5      Tickets are non-transferable and may not be resold or offered, exchanged, or used in advertising, promotion or other commercial purposes without MOTAT’s prior written consent.

3.6      The right of admission to MOTAT is reserved, see clause 9.

4          General Admission Tickets

4.1      One General Admission Ticket purchased entitles one Visitor entry to MOTAT on a single occasion.

4.2      One General Admission Family Ticket purchased entitles up to two adults and four children entry to MOTAT on a single occasion.

4.3      Where Ticket prices vary according to age, the following age classifications apply:

(a)       a person aged 16 years or older is classed as an adult;

(b)       a person aged 5-15 years of age is classed as a child; and

(c)       a person aged 4 years of age or younger has free entry;

4.4      MOTAT reserves the right to request valid photo identification to verify a Visitors age before entry to MOTAT on a Ticket priced according to age.

4.5     Where concessions to General Admission Ticket prices are available, suitable and valid identification must be provided before entry to MOTAT.

5          Special Tickets

5.1      One Special Ticket purchased entitles one Visitor entry to the Event or Programme specified on the Ticket.

5.2      Special Tickets are only valid for the Event or Programme specified on the Ticket.

5.3      Where Ticket prices vary according to age, the following provisions apply:

(a)       a person aged 17 years or older is classed as an adult;

(b)       a person aged 5-16 years of age is classed as a child; and

(c)       a person aged 4 years of age or younger has free entry;

5.4      MOTAT reserves the right to request valid photo identification to verify a Visitors age before entry to MOTAT on a Ticket priced accordingly to age.

5.5      Visitors acknowledge that Special Tickets may be subject to further terms and conditions available on MOTAT’s website, which may require the provision of Personal Information relating to Visitors before purchase.  

6          MOTAT Mates

6.1      One MOTAT Mates Ticket entitles Visitors to:

(a)       unlimited general admission entry to MOTAT for a period of one year following the date of purchase;

(b)       10% off the normal purchase price at MOTAT stores; and

(c)       any additional benefits listed on MOTAT’s website in respect of such a Ticket, which are subject to change.

6.2      By purchasing a MOTAT Mates Ticket you agree to participate in the MOTAT Mates programme and to comply with the specific  terms and conditions relating to the MOTAT Mates Ticket available .

6.3      Where concessions to MOTAT Mates Ticket prices are available, suitable and valid identification must be provided to MOTAT staff.

7          Payment

7.1      MOTAT accepts the following payment methods American Express, Visa and Mastercard, in each case denominated in NZD.

7.2      Payment is processed immediately with your Ticket.  To ensure protection of your credit card details, card payment are processed by third party payment service Windcave.  Credit card details cannot be accessed by MOTAT.

8          Delivery

8.1      Once MOTAT has received full payment for a Ticket or Tickets, Visitors will receive an email confirming the purchase to the email address supplied.  The booking confirmation will include electronic copies of the Tickets purchased.

8.2      If, for any reason, the Ticket purchased is not available, then subject to clause 10, Visitors will be notified via email and provided with a full refund.

8.3      MOTAT will not arrange for postal delivery of any Tickets.

9          Conditions of entry to MOTAT

9.1      All Visitors must comply with the reasonable directions from MOTAT staff at all times, as well as MOTAT’s Terms and Conditions of entry available at:   https://www.motat.nz/legal/terms-and-conditions-of-entry-to-motat/

9.2      MOTAT reserves the right to refuse admission to Visitors where Visitors fail to comply with the Terms and Conditions of entry to MOTAT  as set out in clause 9.1, or these Terms and Conditions. 

9.3      Entry to some Events may require that Visitors submit to a scan of their person and/or their bags prior to entry to the relevant Event venue. 

10       Tickets - refunds, exchanges and replacements

10.1    If an Event or Programme is cancelled, MOTAT will, subject to clause 10.2, refund Special Ticket holders for the full purchase price of the Special Ticket purchased for the relevant cancelled Event or Programme.  For the avoidance of doubt, this clause 10.1 excludes refunds  for General Admission Tickets, General Admission Family Tickets or MOTAT Mates Tickets.

10.2    MOTAT will not refund any purchasers of a Special Ticket for the cost of their Ticket in the event that the cancellation of the relevant Event or Programme is caused by any event outside of MOTAT’s control, including but not limited to:

(a)       inclement weather or any other weather event;

(b)       fire, flood, earthquake or other state of emergency or disaster;

(c)       any delay resulting from strikes, work stoppages or other labour unrest or civil commotion; or

(d)       any delay resulting from any other cause (including acts of third parties) beyond the control of MOTAT or for which MOTAT has no immediately available remedy, which results in the relevant Event or Programme being cancelled or delayed.

10.3    If an Event or Programme at MOTAT is postponed to a later date, MOTAT will offer purchasers of Special Tickets to the relevant Event or  Programme a revised Ticket offer to the postponed date.  MOTAT will offer refunds in accordance with clauses 10.1 and 10.2 to purchasers of Special Tickets who cannot reasonably attend the Event or Programme at the postponed date.

10.4    MOTAT does not offer refunds or exchanges as a result of a change in Visitor’s personal circumstances or ability to use the relevant Ticket.  Visitors expressly agree that their use of, or inability to use, the relevant Ticket is at their sole risk.

10.5    MOTAT will only replace a lost, stolen, damaged or destroyed Tickets if the authenticity of the ticket can be verified, including proof of purchase.  MOTAT may charge a reasonable fee for the replacement of tickets.

10.6    MOTAT is not required to refund a General Admission Ticket or a MOTAT Mates Ticket on the basis that they were unable to be used on a specific date due to Visitor incapacity, illness or other adverse event.

10.7    MOTAT is not required to refund any Ticket price on the grounds that MOTAT or an Event has not met the Visitor’s expectations.   However MOTAT reserves its right to provide a refund on a case by case basis dependent on Visitor experience, entirely at MOTAT’s discretion.

10.8    MOTAT is not required to refund any Ticket price when the Visitor failed to arrive on time for an Event, or has been refused entry to or removed from MOTAT or the Event.

10.9    If a Visitor seeks a Ticket refund in circumstances permitted by these Terms and Conditions, the Visitor must do so within a reasonable time period.

11       Health and Safety

11.1    Visitors must take reasonable care for their own health and safety and take reasonable care that their acts and omissions do not adversely affect the health and safety of others at MOTAT.

11.2    All Visitors must report any accident, incident, damage or hazard or any other matter that may affect the health and safety or other Visitors to MOTAT staff as soon as possible. 

11.3    Children under 14 must be accompanied by a parent, guardian or supervising adult at all times in accordance with governing law, subject to cases where children are participating in staff- supervised Programmes at MOTAT.

12       Privacy

12.1    MOTAT is committed to protecting the privacy of its Visitors and operates in accordance with the Privacy Act 1993.

12.2    MOTAT may collect personal information, including your:

(a)       name;

(b)       contact information;

(c)       date of birth;

(d)       location; and

(e)       billing or purchase information.

12.3     MOTAT may use Personal Information about you in order to:

(a)       positively confirm your identity;

(b)       sell you the correct types of Tickets and products, and in order to offer you special offers relevant to you;

(c)       provide you with information you have requested;

(d)       carry out day to day business; and

(e)       send you information which may be relevant and of interest to you.

12.4    Personal Information is voluntarily provided by Visitors, however the provision of some Personal Information is required to sell Visitors specific Tickets and/or products.

12.5    MOTAT will take reasonable steps to ensure personal information is protected against misuse.  Access to personal information is restricted to relevant MOTAT staff.

12.6    MOTAT will not disclose any Visitor’s personal information (including name and date of birth, as supplied for relevant Ticket purchases)  to any third parties, unless it is required to do so by law or where MOTAT believes that, in good faith,  such action is necessary to comply 
with, a court order, or where disclosure is necessary to prevent or lessen a serious and imminent threat to public health or public safety,  or the life or health of an individual.

12.7    By attending MOTAT or any Event, Visitors consent to being photographed, filmed and recorded and for any photographs or videos to be used in MOTAT promotional materials.

12.8    Visitors have the right to ask for a copy of any Personal Information MOTAT holds about them, and to ask for it to be corrected if they think it is wrong.

13       Limitation of liability

13.1    To the extent permitted by law, MOTAT’s aggregate liability to a Visitor for any breach of these Terms and Conditions or at law is limited to NZ $100.00.

13.2    MOTAT is not liable for any direct, incidental, consequential or indirect damages or loss, loss of profits, revenue or similar, arising from your use of MOTAT’s website to purchase Tickets or from entry to MOTAT.

13.3    MOTAT accepts no liability for any loss or damage to any property left in its custody or control. 

14       Warranties

14.1    Except as expressly provided in these Terms and Conditions, all representations and warranties are excluded to the extent permissible at law.

14.2    Nothing in these Terms and Conditions is intended to limit any Visitor’s rights under the Consumer Guarantees Act 1993.

15       Indemnity

15.1    Each Visitor indemnifies MOTAT against all direct losses or proceedings of any nature suffered or incurred at any time by MOTAT as a direct or indirect result of any act or omission by the Visitor or any breach of the Visitor’s obligations under these Terms and Conditions.

15.2    The above indemnity will not apply:

(a)       to the extent that MOTAT has caused or contributed to the loss, claim, damage, cost, expense, liability or proceeding; or

(b)       to the extent that MOTAT has not actively mitigated its loss.

16       Content Accuracy

16.1    MOTAT endeavours to ensure that all details regarding prices and availability of Events displayed on the MOTAT website or otherwise are correct as at the time of online publication.  However, Ticket prices are subject to change without notice. 

16.2    The Visitor acknowledges that MOTAT is not responsible for the availability, validity or accuracy of any information contained in any third party websites referred to in these Terms and Conditions.

17       Variations to Events

17.1    Advertised Events may be varied or cancelled without notice.

17.2    MOTAT reserves the right to add, withdraw or substitute Events, and to vary seating arrangements or Event capacity without notice.

18       Variation to Terms and Conditions

18.1    MOTAT reserves the right to vary these Terms and Conditions from time to time without providing notice to any Visitor.

18.2    If MOTAT believes that variations to these Terms and Conditions are material, we will inform you by posting an update at the top of this page.

19       Entire Agreement

19.1    These Terms and Conditions constitute the entire agreement between MOTAT and the Visitor relating to the purchase of Tickets, and supersedes all prior representations, warranties, understandings and agreements between MOTAT and the Visitor relating to this.

19.2    Governing Law

19.3    These Terms and Conditions and any separate agreements or terms listed on MOTAT’s website are governed by and shall be construed in accordance with New Zealand law.
